violence acts: Possible offenses contrary to the Crimes Ordinance

If force or violence is used or attempts to obtain sexual gratification, the abuser may have 

  1. committed rape

  2. assault with intent to rape

  3. attempted rape 

  4. indecent assault 

Criminal Intimidation (Threatening injury):

Definition: 
Under section 24 of the Crimes Ordinance ( Cap. 200 ) anyone who threatens another person with an injury to their body, reputation, or intent to cause the threatened person to do any act they are not legal to do.

commits an offense punishable on summary conviction by a fine of $2,000 and imprisonment for two years, and upon indictment by imprisonment for five years.

Section 24 of the Crimes Ordinance addresses conduct directed towards alarming the victim. The threat can be to injure the body, reputation, or property of a third party.

This is not an offense that can be used frequently because it is often difficult to get evidence of the offense, but it is available in appropriate cases.

If the perpetrator is arrested, the arresting officer should explain the procedure and inform the victim of the arresting officer's number and the name of the Police Station to which the abuser will be taken. 

 

If there is insufficient evidence to support the report or accusations against the abuser, the situation and reasons should be explained to the victim as well.

 

There will be two officers involved in each case, one of each gender should attend the incident. According to their code of conduct, the victim should be interviewed by an officer of the same gender, if available, and separately from the perpetrator to ensure privacy and safety. 

 

The victim will never be asked in the presence or hearing of the abuser unless he/she wants to bring a criminal complaint against the abuser and whether he/she would be prepared to give evidence at the court hearing.
